The Homelessness Code of Guidance provides advice to local authorities on discharging their statutory homelessness functions. It provides detailed guidance on interpreting the homeless legislation set out in part VII of the Housing Act 1996. Local authorities must have regard to the guidance in carrying out their enquiries into any homeless application.
However, it is only guidance and not a legally binding document. It has on occasions been ignored, criticised and dismissed by the courts in their consideration of it. Despite this, YOTs should be willing to challenge those local authorities who fail to take it into account in their enquiries into any young person’s homelessness.
The Code of Guidance highlights the fact that homelessness strategies should link with other programmes that address causes of homelessness, including crime and disorder strategies and the work of YOTs.
